A BILL to amend article fifteen, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section nineteen,
relating to deferral of filing fees and costs incidental to
bringing actions in magistrate court for the collection of
delinquent ambulance bills by county ambulance authorities and
county commissions.
Be it enacted by the Legislature of West Virginia:

That article fifteen, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
nineteen, to read as follows:
ARTICLE 15. EMERGENCY AMBULANCE SERVICE ACT OF 1975.
§7-15-19. Deferral of court costs and fees when collecting
delinquent emergency ambulance bills.

Emergency ambulance authorities and county commissions are
granted a deferral of filing fees or other fees and costs
incidental to the bringing and maintenance of an action in
magistrate court for the collection of delinquent ambulance bills.
If the authority or commission prevails the court shall include in
its order a requirement that the user or other responsible party
pay to the clerk all deferred fees and costs.





NOTE: The purpose of this bill is to
allow the deferral of
filing fees and costs incidental to the bringing actions in
magistrate court for the collection of delinquent ambulance bills
by county ambulance authorities or county commissions.
